1. Agreement to Terms

These Terms of Use ("Terms") constitute a legally binding agreement between you (individually or on behalf of an entity, "you" or "User") and Realflow.ai ("Realflow," "RealflowCloud," "we," "us," or "our") governing your access to and use of the Realflow.ai website (the "Site") and the Realflow Software-as-a-Service platform (the "Service").

BY ACCESSING OR USING THE SERVICE, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, YOU MAY NOT ACCESS OR USE THE SERVICE.

If you are accessing or using the Service on behalf of an organization:

  • You represent that you have authority to bind that organization to these Terms
  • "You" and "User" refer to both you as an individual and the organization

2. Definitions

"Account" means your registered user account on the Service.

"Connector" means a pre-built integration to third-party services (CRMs, databases, APIs, etc.).

"Content" means any data, text, software, code, workflows, configurations, files, images, or other materials uploaded, created, or transmitted through the Service.

"MCP Service" means a Model Context Protocol service created using the Realflow platform.

"API Service" means an API service created using the Realflow platform.

"Subscription" means your paid access to the Service under a specific pricing tier.

"User Content" means Content that you or your authorized users create, upload, or submit to the Service.

"Workflow" means an automated process created using the Service, including SQL queries, data transformations, human-in-the-loop approvals, and connector integrations.

"Multi-Tenant Environment" means the shared infrastructure where multiple subscribers' workflows execute on common resources.

"Dedicated Environment" means isolated infrastructure allocated exclusively to a single subscriber (available in Dedicated, and BYOC Enterprise tiers).


3. Eligibility and Account Registration

3.1 Eligibility

You must:

  • Be at least 18 years of age (or legal age in your jurisdiction)
  • Have the legal capacity to enter into binding contracts
  • Not be prohibited from using the Service under applicable law
  • Not be located in a country subject to U.S. embargo or designated as a "terrorist supporting" country
  • Not appear on any U.S. government list of prohibited or restricted parties

3.2 Account Registration

To use the Service, you must:

  • Provide accurate, current, and complete registration information
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Notify us immediately of unauthorized access
  • Accept responsibility for all activities under your account

3.3 Organization Accounts

If registering on behalf of an organization:

  • You warrant that you have authority to bind the organization
  • The organization is responsible for all user activity under the account
  • You must designate an account administrator
  • You are responsible for managing user permissions

3.4 Account Security

You are solely responsible for:

  • Maintaining the confidentiality of login credentials
  • Keep your assigned clientids and secrets secure and confidential
  • Keep your API keys secure and confidential and never embed them in code visible (such as in JavaScript)
  • All activities that occur under your account
  • Ensuring compliance with these Terms by all account users
  • Promptly notifying us of any security breach

We are not liable for losses resulting from unauthorized account access due to your failure to safeguard credentials.


4. Subscription Plans and Pricing

4.1 Subscription Tiers

Realflow offers multiple subscription tiers:

Starter Tier ($79/month):

  • Shared multi-tenant environment
  • Standard workflow execution limits
  • Starter SLA
  • Community support
  • 185+ pre-built connectors

Professional Tier ($299/month):

  • Login/RBAC features
  • Data classes and covenants features
  • Higher execution limits
  • Higher SLA
  • Priority support
  • Advanced features

Dedicated Tier ($799/month):

  • Your own cloud infrastructure
  • Full isolation from multi-tenant environment
  • Custom resource allocation
  • Premium support

Enterprise Tier (Custom Pricing):

  • Custom deployment options
  • Dedicated account management
  • Service Level Agreements (SLAs)
  • Custom connector development

4.2 Billing and Payment

  • Subscriptions are billed monthly or annually in advance
  • Payment processed through third-party payment processors
  • You authorize recurring charges to your payment method
  • We are happy to invoice for Professional and above with a valid PO
  • Prices exclude applicable taxes (added at checkout)
  • All fees are non-refundable except as required by law or stated in these Terms

4.3 Price Changes

  • We may change pricing with 30 days' advance notice
  • Price changes do not affect your current billing cycle
  • Continued use after notice constitutes acceptance of new pricing
  • You may cancel before new pricing takes effect

4.4 Free Trials and Promotional Offers

  • Free trials are subject to resource limits and restrictions
  • We may discontinue trials at any time
  • One trial per user/organization/tier unless otherwise stated
  • Promotional pricing may be time-limited

4.5 Payment Failure

If payment fails:

  • We will attempt to notify you
  • Service may be suspended after 7 days
  • Account may be terminated after 30 days
  • You remain liable for all unpaid amounts
  • Reactivation may require payment of all outstanding amounts plus reactivation fee

5. Acceptable Use Policy

5.1 Permitted Uses

You may use the Service to:

  • Create and execute workflows for lawful business purposes
  • Configure the services in the Realflow.studio admin tool
  • Build MCP services for internal or customer use
  • Build API services for internal or customer use
  • Connect to authorized third-party services
  • Generate reports, forms, and documents
  • Implement human-in-the-loop approval processes
  • Share links with authorized recipients
  • Process data in compliance with applicable laws

5.2 Prohibited Uses

You may NOT use the Service to:

Illegal Activities:

  • Violate any applicable laws or regulations
  • Infringe intellectual property rights
  • Engage in fraudulent activities
  • Facilitate illegal transactions
  • Violate export control laws

Harmful Content:

  • Transmit malware, viruses, or malicious code
  • Engage in phishing or social engineering
  • Distribute spam or unsolicited communications
  • Host or distribute pirated content
  • Create or distribute child sexual abuse material

Abusive Behavior:

  • Harass, threaten, or defame others
  • Engage in hate speech or incite violence
  • Violate privacy rights
  • Impersonate others
  • Stalk or intimidate users

Security Violations:

  • Attempt to breach security measures
  • Access other users' accounts without authorization
  • Interfere with Service operation or integrity
  • Conduct vulnerability scanning without permission
  • Bypass rate limits or usage restrictions

Data Misuse:

  • Scrape or harvest data without authorization
  • Use data for unauthorized marketing
  • Sell or share user data inappropriately
  • Process data in violation of privacy laws
  • Store sensitive data without proper encryption

5.3 Resource Abuse and Multi-Tenant Environment Protection

CRITICAL RESTRICTIONS FOR SHARED ENVIRONMENT:

Realflow operates a multi-tenant environment where multiple subscribers share infrastructure resources. To ensure fair access and service stability for all users, the following restrictions apply:

Prohibited Resource Abuse:

  • Creating workflows that consume excessive CPU, memory, or storage
  • Running infinite loops or non-terminating processes
  • Executing workflows at frequencies that monopolize shared resources
  • Creating an unreasonable number of concurrent workflow executions
  • Generating excessive database queries or API calls
  • Storing excessive amounts of data beyond subscription limits
  • Using the Service for cryptocurrency mining or similar resource-intensive operations
  • Intentionally destabilizing the multi-tenant environment

Usage Thresholds:

While we do not publish specific resource limits (as they vary by subscription tier and system capacity), subscribers must:

  • Use resources reasonably and in good faith
  • Design workflows for efficiency
  • Monitor their resource consumption
  • Respond promptly to notifications about excessive usage
  • Optimize poorly performing workflows when identified

Our Response to Resource Abuse:

We will make every reasonable effort to accommodate legitimate usage spikes and work with you to optimize workflows. However, sustained resource abuse may result in:

  1. Monitoring and Notification: We will notify you if your usage patterns threaten service stability
  2. Technical Assistance: We will offer guidance on optimizing resource-intensive workflows
  3. Throttling: Temporary rate limiting or execution delays to protect the multi-tenant environment
  4. Service Restriction: Temporary suspension of specific workflows or connectors causing excessive load
  5. Service Suspension: Temporary suspension of your account if abuse continues after notification
  6. Mandatory Tier Migration: Requirement to upgrade to Professional tier (dedicated resources) or BYOC tier
  7. Account Termination: Permanent termination for intentional abuse or refusal to remediate

Upgrade Path:

If your legitimate business needs exceed shared environment capacity:

  • We will work with you to identify appropriate solutions
  • BYOC tier ($799/month) provides dedicated resources and complete isolation with your own infrastructure.  As long as you accept the limitations of your dedicated servers, you are not subject to these fair-use terms
  • Enterprise tier offers custom resource allocation including auto-scaling (we run the multi-tenant environment on Kubernetes)

Fair Use Principle:

These restrictions implement a "fair use" principle: your use must not materially impair other subscribers' ability to use the Service. We reserve sole discretion to determine what constitutes resource abuse, but will act reasonably and provide notice before taking action (except in emergencies).

5.4 Compliance Obligations

You must:

  • Comply with all applicable data protection laws (GDPR, CCPA, etc.)
  • Obtain necessary consents for data processing
  • Provide required privacy notices to end users
  • Implement appropriate security measures
  • Report security incidents promptly
  • Maintain accurate records as required by law
  • Cooperate with lawful requests from authorities

5.5 Third-Party Services

When using Connectors to third-party services:

  • You must comply with third-party terms of service
  • You are responsible for obtaining necessary permissions
  • We are not responsible for third-party service availability or conduct
  • You must secure and manage your own API keys and credentials
  • Connectors are provided "as-is" without warranty

6. User Content and Intellectual Property

6.1 Your Content Ownership

You retain all rights, title, and interest in your User Content. You are solely responsible for:

  • The accuracy and legality of your User Content
  • Obtaining necessary rights to use and process data
  • Compliance with applicable laws
  • Backup of your User Content

6.2 License Grant to Realflow

By uploading User Content, you grant Realflow a limited, worldwide, non-exclusive, royalty-free license to:

  • Host, store, and process your User Content
  • Execute workflows you create
  • Display your Content as necessary to provide the Service
  • Make backup copies for disaster recovery
  • Perform technical operations (indexing, optimization, etc.)

This license:

  • Exists only to provide the Service
  • Does not grant us ownership rights
  • Terminates when you delete Content or terminate your account (subject to backup retention periods)
  • Does not permit us to use your Content for training AI models without explicit consent

6.3 Realflow Intellectual Property

The Service, including all software, designs, text, graphics, interfaces, and underlying technology, is owned by RealflowCloud, Inc. and protected by:

  • Copyright laws
  • Trademark laws
  • Trade secret laws
  • Patent laws (where applicable)
  • Other intellectual property rights

You may not:

  • Copy, modify, or reverse engineer the Service
  • Remove proprietary notices
  • Use our trademarks without permission
  • Create derivative works
  • Sublicense or resell the Service

6.4 Workflow Configurations

Workflow configurations you create (SQL queries, transformation logic, connector settings) are your intellectual property. However:

  • Generic workflow patterns may be used to improve the Service
  • We may create anonymized analytics from workflow usage
  • Publicly shared workflows may be featured in our marketplace (with attribution)

6.5 Feedback and Suggestions

If you provide feedback, suggestions, or ideas:

  • You grant us unlimited rights to use such feedback
  • No compensation is owed for feedback
  • We may implement suggestions without attribution
  • Feedback is provided voluntarily

7. Service Level and Availability

7.1 Service Availability

Starter and Professional Tiers:

  • We strive for high availability but do not guarantee uptime
  • Maintenance windows may be scheduled with notice
  • Service interruptions may occur without prior notice

BYOC & Enterprise Tier:

  • Service Level Agreements (SLAs) specified in your Enterprise Agreement
  • Guaranteed uptime percentages
  • Credits (only) for SLA breaches

7.2 Scheduled Maintenance

We may perform scheduled maintenance:

  • With at least 48 hours' notice for major maintenance
  • During off-peak hours when possible
  • With minimal disruption to workflows

7.3 Emergency Maintenance

Unscheduled maintenance may occur for:

  • Security vulnerabilities
  • Critical bugs
  • System failures
  • Protection of the multi-tenant environment

7.4 Service Modifications

We reserve the right to:

  • Modify or discontinue features with 30 days' notice
  • Update the Service for security or performance
  • Add or remove Connectors
  • Change technical specifications
  • Retire legacy functionality

Material Changes:

  • 90 days' notice for material feature removals
  • Migration tools provided when possible
  • Alternative solutions offered when feasible

7.5 No Warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

We do not warrant that:

  • The Service will be uninterrupted or error-free
  • Defects will be corrected
  • The Service is free of viruses or harmful components
  • Results will meet your requirements

8. Data Management and Backups

8.1 Data Storage

  • Your data is stored in our multi-cloud infrastructure (Azure, DigitalOcean)
  • Storage limits vary by subscription tier
  • Exceeding limits may result in additional charges or service restrictions
  • Data is encrypted at rest and in transit

8.2 Backups

Our Backup Responsibilities:

  • Regular automated backups for disaster recovery
  • Backup retention periods vary by tier (typically 30 days)
  • Backups are for our operational purposes, not guaranteed data recovery

Your Backup Responsibilities:

  • You are solely responsible for maintaining your own backups
  • Export critical workflows and data regularly
  • We are not liable for data loss
  • Deleted data may not be recoverable after retention periods

8.3 Data Export

You may export:

  • Workflow configurations
  • Execution logs (subject to retention periods)
  • User Content
  • Connection metadata (not credentials)

Export formats:

  • JSON for workflow configurations
  • CSV for tabular data
  • Standard formats where applicable

8.4 Data Deletion

Upon account termination:

  • Active data deleted within 30 days
  • Backups deleted according to retention schedules (up to 90 days)
  • Some metadata retained for legal compliance (7 years for billing records)
  • Shared links expire and associated data deleted

You may request immediate deletion by contacting support, subject to:

  • Legal retention requirements
  • Pending transactions or disputes
  • Technical limitations

9. Term and Termination

9.1 Term

These Terms remain in effect while you access or use the Service.

9.2 Termination by You

You may terminate at any time by:

  • Canceling your subscription through account settings
  • Emailing support@realflow.ai
  • Providing 30 days' written notice for annual subscriptions

Upon cancellation:

  • Access continues until end of current billing period
  • No refunds for partial periods (except as required by law)
  • Data export available for 60 days after termination

9.3 Termination by Us

We may suspend or terminate your account:

Immediately and Without Notice:

  • Violation of Acceptable Use Policy
  • Resource abuse threatening service stability
  • Illegal activity
  • Security threat to the Service or other users
  • Fraudulent payment information
  • Material breach of these Terms

With Notice:

  • Non-payment (7 days' notice)
  • Repeated minor violations (30 days' notice to cure)
  • Discontinuation of the Service (90 days' notice)

9.4 Effect of Termination

Upon termination:

  • Your access to the Service immediately ceases
  • All licenses granted to you terminate
  • Shared links expire
  • Active workflows stop executing
  • Data deletion begins according to our retention policy
  • You remain liable for all amounts owed

Survival: Sections regarding intellectual property, indemnification, limitation of liability, dispute resolution, and any payment obligations survive termination.

9.5 Suspension

We may temporarily suspend access without terminating your account:

  • During investigation of suspected violations
  • To protect the multi-tenant environment
  • For non-payment (pending payment resolution)
  • At your request

Suspended accounts:

  • Cannot execute workflows
  • Cannot access most Service features
  • Retain data during suspension period
  • Resume billing unless formally canceled

10. Privacy and Data Protection

10.1 Privacy Policy

Our collection and use of personal information is governed by our Privacy Policy, incorporated by reference into these Terms. By using the Service, you consent to our Privacy Policy.

10.2 Data Controller and Processor Roles

For Your Account Data:

  • Realflow is the data controller
  • We process your account data to provide the Service

For End User Data in Your Workflows:

  • You are the data controller
  • Realflow is the data processor acting on your instructions
  • You are responsible for providing privacy notices to your end users
  • You must obtain necessary consents

10.3 Data Processing Addendum

For subscribers subject to GDPR or similar laws, we offer a Data Processing Addendum (DPA) that includes:

  • Standard Contractual Clauses
  • Processing obligations
  • Security measures
  • Sub-processor lists
  • Data breach notification procedures

Contact legal@realflow.ai to execute a DPA.

10.4 Confidentiality

We will maintain the confidentiality of:

  • Your User Content
  • Workflow configurations
  • Business information
  • Connection credentials (encrypted)

Exceptions:

  • Required by law
  • With your consent
  • To provide the Service (including sub-processors)
  • Publicly available information
  • Independently developed information

11. Indemnification

11.1 Your Indemnification Obligations

You agree to indemnify, defend, and hold harmless Realflow, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

  • Your violation of these Terms
  • Your violation of any law or regulation
  • Your User Content
  • Your use of the Service
  • Infringement of third-party rights
  • Your end users' claims related to workflows you created
  • Resource abuse or destabilization of the multi-tenant environment
  • Unauthorized access to third-party services using Connectors
  • Your failure to obtain necessary consents or provide required notices

11.2 Indemnification Process

For indemnification claims:

  • We will notify you promptly of any claim
  • You will have sole control of defense and settlement (with our consent on settlements affecting us)
  • We may participate in defense at our expense
  • You will not settle claims without our written consent if settlement imposes obligations on us

11.3 Our Indemnification (Limited)

Realflow will indemnify you against third-party claims that the Service infringes that party's intellectual property rights, provided:

  • You notify us promptly of the claim
  • We have sole control of defense and settlement
  • You cooperate reasonably in the defense

Our obligations do NOT apply if infringement results from:

  • Your modification of the Service
  • Your combination of the Service with other products
  • Your continued use after we provided a non-infringing alternative
  • Your User Content
  • Third-party Connectors

Our sole remedy: modify Service to be non-infringing, obtain license, or terminate Service and refund prepaid fees for unused period.


12. Limitation of Liability

12.1 Disclaimer of Consequential Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, REALFLOW AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING:

  • Lost profits or revenue
  • Loss of data or Content
  • Loss of business opportunity
  • Business interruption
  • Reputational harm
  • Cost of substitute services

This applies regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise), even if we have been advised of the possibility of such damages.

12.2 Limitation on Direct Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, REALFLOW'S TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE IS LIMITED TO THE GREATER OF:

  • $100 USD, OR
  • AMOUNTS YOU PAID TO REALFLOW IN THE 12 MONTHS PRECEDING THE CLAIM

12.3 Exceptions to Limitations

The above limitations do NOT apply to:

  • Your indemnification obligations
  • Your payment obligations
  • Liability that cannot be excluded under applicable law
  • Damages arising from willful misconduct or gross negligence by Realflow
  • Violations of intellectual property rights

12.4 Basis of the Bargain

You acknowledge that the limitations of liability are fundamental elements of the agreement between you and Realflow, and the Service would not be provided without such limitations.

12.5 Multiple Claims

The existence of multiple claims will not expand the limitation of liability.


13. Dispute Resolution

13.1 Informal Resolution

Before filing a claim, you agree to contact us at legal@realflow.ai to attempt informal resolution. We will attempt to resolve disputes through good-faith negotiation for 30 days.

13.2 Governing Law

These Terms are governed by the laws of Delaware, without regard to conflict of law principles.

13.3 Arbitration Agreement

Binding Arbitration: Any dispute arising from or relating to these Terms or the Service will be resolved through binding arbitration rather than in court, except:

  • Small claims court actions (under jurisdictional limits)
  • Intellectual property disputes
  • Actions to enforce arbitration awards
  • Injunctive relief for violations of Acceptable Use Policy

Arbitration Rules:

  • Administered by the American Arbitration Association (AAA)
  • AAA's Commercial Arbitration Rules apply
  • Single arbitrator selected according to AAA rules
  • Arbitration location: [Insert City, State]
  • Each party bears their own costs (unless otherwise awarded by arbitrator)

Class Action Waiver: YOU AND REALFLOW AGREE THAT DISPUTES WILL BE RESOLVED ONLY ON AN INDIVIDUAL BASIS AND NOT AS A CLASS ACTION, CONSOLIDATED ACTION, OR REPRESENTATIVE ACTION. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION AGAINST REALFLOW.

13.4 Opt-Out of Arbitration

You may opt out of the arbitration agreement by sending written notice to legal@realflow.ai within 30 days of first accepting these Terms. Opt-out notice must include your name, address, and a clear statement that you wish to opt out of arbitration.

13.5 Exceptions to Arbitration

Either party may seek:

  • Injunctive relief in court for violations of intellectual property rights or Acceptable Use Policy
  • Small claims court resolution (within jurisdictional limits)

13.6 Venue for Non-Arbitrated Disputes

If arbitration does not apply, disputes will be resolved in the state or federal courts located in [Insert County, State], and you consent to personal jurisdiction in those courts.


14. General Provisions

14.1 Entire Agreement

These Terms, together with the Privacy Policy and any other incorporated documents, constitute the entire agreement between you and Realflow regarding the Service and supersede all prior agreements.

14.2 Amendments

We may modify these Terms at any time by:

  • Posting updated Terms on the Site
  • Notifying you via email or in-app notification
  • Updating the "Last Updated" date

Material Changes:

  • 30 days' notice for material changes
  • Continued use constitutes acceptance
  • If you disagree, you must terminate your account

14.3 Waiver

Failure to enforce any provision does not constitute a waiver of that provision. Any waiver must be in writing and signed by Realflow.

14.4 Severability

If any provision is found invalid or unenforceable, the remaining provisions remain in full force and effect. Invalid provisions will be modified to the minimum extent necessary to make them enforceable.

14.5 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets with notice to you.

14.6 Force Majeure

We are not liable for delays or failures in performance resulting from circumstances beyond our reasonable control, including:

  • Natural disasters
  • War, terrorism, or civil unrest
  • Government actions or regulations
  • Internet or utility failures
  • Pandemics
  • Labor disputes
  • Supplier failures

14.7 Independent Contractors

You and Realflow are independent contractors. These Terms do not create a partnership, joint venture, employment, or agency relationship.

14.8 Third-Party Beneficiaries

These Terms do not create rights for any third parties.

14.9 Export Compliance

You represent that you are not located in a country subject to U.S. embargo or designated as a "terrorist supporting" country, and you are not on any U.S. government list of prohibited or restricted parties.

You agree to comply with all export laws and not export or re-export the Service to prohibited destinations or persons.

14.10 Government Users

If you are a U.S. government entity, the Service is "Commercial Computer Software" and "Commercial Computer Software Documentation" as defined in FAR 12.212 and DFARS 227.7202. Use is governed by these Terms.

14.11 Language

These Terms are drafted in English. Any translations are provided for convenience only. In case of conflict, the English version controls.

14.12 Notices

To You: Notices will be sent to the email address associated with your account. You must keep your email address current.

Notices are effective upon receipt.

14.13 Survival

Provisions that by their nature should survive termination will survive, including: intellectual property rights, indemnification, limitation of liability, dispute resolution, and payment obligations.


15. Specific Service Terms

15.1 Human-in-the-Loop Workflows

When creating workflows with pause/resume functionality:

  • Approval links expire according to your configuration
  • Approvers are responsible for timely review
  • Pause states are stored securely but subject to system limits
  • Long-paused workflows may be archived after 90 days of inactivity
  • You are responsible for notification delivery failures

15.2 Shared Links

When generating shareable links:

  • You control expiration dates
  • You are responsible for link distribution
  • Links may be deactivated for security reasons
  • Usage tracking data is subject to retention policies
  • You must provide privacy notices to link recipients

15.3 File Generation

When generating reports, forms, or zip files:

15.4 SMS and Email Notifications

When sending notifications:

  • Delivery charges may apply for high-volume use
  • You must comply with CAN-SPAM and similar laws
  • You are responsible for obtaining recipient consent
  • Opt-out mechanisms must be functional
  • We may suspend notification features for abuse

15.5 Connectors

When using Connectors:

  • Third-party terms of service apply
  • Connector availability not guaranteed
  • API rate limits apply
  • You must secure your own API keys
  • We may add or remove Connectors at any time
  • Custom connectors (Enterprise tier) subject to separate terms

15.6 SQL and Data Processing

When creating SQL queries:

  • Queries must comply with SQL-92 standard
  • Queries are sandboxed for security
  • Resource-intensive queries may be terminated
  • You are responsible for query optimization
  • We may analyze queries to prevent injection attacks

16. Fair Use and Resource Management

16.1 Fair Use Principles

The Service is designed for legitimate business automation. "Fair use" means:

  • Using resources proportionate to your subscription tier
  • Designing efficient workflows
  • Responding to optimization requests
  • Not intentionally destabilizing shared infrastructure
  • Acting in good faith

16.2 Resource Monitoring

We monitor:

  • Workflow execution times
  • CPU and memory usage
  • Database query patterns
  • Storage consumption
  • API call volumes
  • Concurrent executions

16.3 Optimization Assistance

If we identify resource issues, we will:

  • Notify you with specific metrics
  • Provide optimization recommendations
  • Offer technical consultation
  • Suggest appropriate subscription tiers
  • Work collaboratively on solutions

16.4 Enforcement Escalation

For sustained resource abuse:

First Notice: Email with metrics and recommendations (no service impact)

Second Notice: 7 days to optimize or upgrade tier (no service impact yet)

Throttling: Temporary rate limiting if issues persist after second notice

Mandatory Upgrade: Requirement to move to Professional or BYOC tier within 30 days

Suspension: Temporary account suspension if upgrade not completed

Termination: Account termination for refusal to remediate or intentional abuse

We will work with you in good faith throughout this process. Our goal is resolution, not termination.


17. Beta Features and Experimental Services

17.1 Beta Designation

Some features may be designated as "Beta," "Alpha," "Preview," or "Experimental." These features:

  • Are provided for testing and feedback
  • May contain bugs or errors
  • May be changed or discontinued without notice
  • Are provided "AS IS" with no warranties
  • May have limited or no support
  • Should not be used for production workloads

17.2 Feedback on Beta Features

If you use Beta features:

  • You agree to provide feedback if requested
  • You grant us rights to use your feedback
  • You acknowledge features may not reach general availability
  • Data generated in Beta features may not be migrated

18. Service Credits and Refunds

18.1 Service Credits

Service credits may be issued for:

  • SLA breaches (Enterprise tier only)
  • Significant service outages (at our discretion)
  • Billing errors
  • Documented service failures

Credits:

  • Applied to future billing
  • Not redeemable for cash
  • Expire after 12 months
  • Do not extend subscription terms

18.2 Refund Policy

Generally Non-Refundable: All fees are non-refundable except:

  • As required by law
  • Cancellation within 7 days of initial purchase (first-time subscribers only)
  • At our sole discretion for extenuating circumstances

No Refunds For:

  • Partial billing periods
  • Unused features
  • Service dissatisfaction
  • Account termination for violations
